My Name is Neil Kelly and I am a Paralegal and Accountant based in Medicine Hat, Alberta. I am available to represent you as your court agent within the judicial districts of Medicine Hat, Lethbridge, Calgary, and Drumheller.

What is a Paralegal?

A Paralegal is a person with formal legal training that is not a lawyer. I am allowed to carry out your instructions in areas specifically authorized by Federal and Provincial legislation and regulations. Your right to be assisted by a Paralegal, (or the term "Agent" as used in the Criminal Code of Canada) has been affirmed by many superior courts, including the Supreme Court of Canada, in several rulings.

Among the areas where you are allowed to retain a paralegal are:

  • Most Summary Criminal Matters (under six month sentence)

  • Small Claims Actions (up to $25,000 in Alberta)

  • Landlord and Tenant Disputes

  • WCB and EI tribunals

  • Most traffic matters

  • Uncontested divorces (document preparation )

  • Judgment Recovery

The main advantage of using a Paralegal is cost. My fees are, in almost every case, substantially lower than what you would be charged by a lawyer.

Since I am not yet a lawyer, I am not permitted to give you legal advice or issue a legal opinion regarding the matters under discussion. However, I can act on your instructions and carry out your wishes in areas where I am allowed to practise.

NUANS Searches!

The first step in setting up a new corporation, or moving a company to another jurisdiction, is obtaining a NUANS Report. This report allows the Registrar to determine if there are companies with exact or confusingly similar names already registered. It also allows you to determine if there are any existing trademarks that could bar you from using the name you have chosen even if it can be registered under current legislation. This report is also required before a company can be incorporated Federally. I am a NUANS Agent, which allows me to process reports that will be used for registration purposes.

Incorporate!

I can assist you with establishing a basic Alberta, Saskatchewan, British Columbia, Saskatchewan or Federal Corporation. This includes preparing the paperwork, filing documents with the appropriate government agency, and providing you with the necessary minute books needed to maintain your new company. I can not provide legal advice on how the company should be structured, but this is usually not a problem for small one or two person companies. I can also assist you with registered office services, extra-provincial registration, trade name and partnership registrations. I can refer you to a lawyer if your needs go beyond what I can provide you.
