Divorce Page There are basiclly two types of divorce actions in Alberta. One is a contested action. If there are outstanding issues between you and your ex-spouse including division of matrimonial property, custody and access to children, or spousal and child support then your divorce would be considered a contested action. If you are involved in this type of dispute, then you need a lawyer to assist you. The second type of divorce is an uncontested action, otherwise known as a DESKTOP divorce. If all issues of child custody and access, spousal and child support, and matrimonal property issues have been agreed between the parties, then you are a good candidate for an uncontested divorce action. In this case we will provide properly completed documents and will file them with the courts on your behalf. In Alberta these types of divorces can be completed without either party appearing in Court. At no time can we provide you with any legal advice. We can act as a mediator between you and your ex-spouse and will try to resolve outstanding issues without resorting to a lawyer. In the event we feel the issues can not be resolved, or if the dispute requires legal advice, then we will advise both parties to retain a lawyer at that time. If you decide my services are suitable for your situation, and you would like me to assist you with completing your divorce, then the cost will be $500.00 with no children or $600.00 with minor children. The above fee includes preparation, copying, and filing of all required documents with the Court of Queen's Bench. Our fee does NOT include the $210 court filing fee. in addition, costs to serve documents on your ex-spouse, or the cost of obtaining a certified marriage certificate may be extra. At least one of the parties must has lived in Alberta for at least 12 months before filing the divorce action in order to file in the Alberta Court of Queen's Bench. Some complicated matters may require additional court filings and incur additional costs. All anticipated fees will be fully disclosed prior to commencing any action if required. GST must be added to all fees.
