Small claims actions in Alberta are heard in the Civil Division of the Provincial Court of Alberta. This court has jurisdiction over matters like the following:

  1. NSF Checks

  2. Landlord & Tenant Issues
  3. Contracts
  4. Accidents

This court can hear matters with a monetary value of up to $25,000, which puts most matters arising between individuals within the jurisdiction of the court. They can also determine landlord and tenant issues like orders for possession and arrears for non-payment of rent and damages that exceed the value of the damage deposit.

If the action is being heard in Medicine Hat, Lethbridge, Brooks, Taber or even Calgary then we are available to appear on your behalf. For other court jurisdictions we are available to prepare all the necessary documents and advise you how to proceed on your own.

You do not need to be represented by a lawyer or even by a paralegal, because the judge has wider discretion to assist participants than in the Court of Queen's Bench. However, you must still present the essential elements of your case in order to prove your claim or defend a suit in order to prevail at the trial phase.

The first step for any small claims action is to issue a Statement of Claim. Or if you are sued, file a Dispute Note. Once both of these steps have been taken then the matter is set down for a Pre-Trial Conference. This conference can be held either in person at the court house or on the telephone. This meeting will help the judge determine the actual issues to dealt with at trial. At this time the judge will inform the parties of the consequences of proceeding to trial with no valid claims. The judge has wide powers to award costs to the other party if the claim is deemed to be without merit. Participation in the Pre-Trial Conference is mandatory.
